Terms of Service

These Terms of Service ("Terms") govern your access to and use of the games, applications, websites, player support, and related services provided by NEXORA INTERACTIVE LLC ("NEXORA," "we," "us," or "our") that link to or expressly incorporate these Terms (collectively, the "Services"). The Services include our mini games made available within the distribution platform and our games distributed through other supported platforms. These Terms form an agreement between you and NEXORA INTERACTIVE LLC and apply across those Services without requiring a separate set of terms for each game.

Features, content, purchases, subscriptions, and advertising may differ between games, versions, platforms, and regions. A provision concerning a particular feature applies when that feature is available in the Service you use. Game-specific or regional supplemental terms may apply if clearly presented to you before the relevant use or purchase. If supplemental terms conflict with these Terms, they prevail only for the identified game, feature, or region and only to the extent of the conflict, subject to applicable law. Mandatory consumer rights remain unaffected.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Where applicable law requires a particular form of acceptance, we will obtain acceptance in that form.

Our Privacy Policy explains how we collect, use, share, and retain personal data and how you may exercise your privacy rights. It is available at: https://www.nexoragame.org/privacy-policy. Acceptance of these Terms does not itself constitute consent to optional personal data processing.

1. Eligibility

You must be at least 13 years old and meet any higher minimum age required by applicable law, the platform through which you access the Services, or restrictions applicable to the game. If you are under the age of legal majority where you live, you may use the Services only with the permission of a parent or legal guardian and subject to applicable law. Parental permission does not override a minimum age restriction.

Certain features, including purchases, may have additional eligibility requirements. You must meet those requirements before using the relevant feature.

2. Access Through Distribution Platforms

We provide and operate our games and are responsible for the Services we provide. the distribution platform and other distribution platforms operate their own services. If you access a game through the distribution platform or another platform, your use of that platform is also subject to its applicable terms and policies. These Terms do not replace those terms or grant you rights to use a platform contrary to its rules.

Availability of a game may depend on your region, device, platform account status, and platform availability. We cannot create, suspend, restore, or otherwise control your the distribution platform or other third-party platform account. References in these Terms to action we take against an account concern your game account or access to our Services.

3. Limited License and Intellectual Property

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Services for non-commercial entertainment. Revocation is subject to the suspension and termination provisions below and applicable law.

The Services, including software, artwork, graphics, music, audio, text, characters, names, and logos, are owned by NEXORA INTERACTIVE LLC or its licensors and are protected by intellectual property laws. Except as permitted by law or expressly authorized by the relevant rights holder, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services. No ownership rights are transferred to you.

4. Accounts and Security

Some features use a game account or platform login. You must provide accurate information where requested, protect any login credentials you control, and promptly report suspected unauthorized access to support@nexoragame.org. Do not disclose passwords or payment credentials to our support team.

You are responsible for your own conduct and for activity you authorize through your game account. This does not make you responsible for unauthorized activity to the extent applicable law provides otherwise. We may restrict a game username or game access where reasonably necessary to address impersonation, security incidents, or violations of these Terms.

5. Virtual Items, Purchases, and Subscriptions

The Services include in-game purchases and subscription offerings, as well as virtual currency, items, or other digital content earned through gameplay. The offerings available to you depend on the game, version, platform, and region. Product descriptions and purchase screens identify the relevant content, benefits, price, applicable taxes or charges, and any material restrictions before you confirm a purchase.

Unless an offer expressly states otherwise, a purchase, subscription, or game virtual item applies only to the identified game and account and does not grant benefits in our other games. Availability across devices or platforms depends on the specific offer and supported account features. Only make purchases you are authorized to make using the selected payment method.

Game virtual items are licensed for use within the Services, not sold as property. Unless required by applicable law, they have no cash redemption value and cannot be exchanged for money, goods, or services outside the Services. They must not be sold or transferred except through features expressly permitted by us and the applicable platform.

Where purchases are enabled in the the distribution platform version, transactions use the purchase mechanisms authorized by the distribution platform for that version and region, which may include platform credits. platform credits are distinct from virtual items issued by us and are governed by the applicable the distribution platform terms. The purchase screen will identify the item, price or platform credits amount, and material conditions before confirmation. Do not make payments through unauthorized third-party channels.

Purchases and refund requests are subject to applicable law and the rules of the platform that processes the transaction. Except where applicable law or platform policy provides otherwise, completed purchases are final. Nothing in these Terms excludes a statutory right to a refund, cancellation, repair, replacement, or other remedy.

For missing items, duplicate charges, or other purchase problems, contact support@nexoragame.org with your game identifier and transaction reference, without sending passwords or full payment details. Use the applicable platform refund process where required; we will assist with game delivery issues and relevant transaction information within our control.

Subscriptions provide the benefits described in the relevant offer for the stated subscription period. They are offered only through mechanisms permitted by the relevant platform and in supported regions. Before you subscribe, the purchase screen will state the benefits, price, billing period, whether renewal is automatic, any trial or introductory offer, and the method and applicable deadline for cancellation. A fixed-term, non-renewing offer ends on the date stated in the offer. No recurring charge is authorized merely by accepting these Terms.

If you expressly choose an automatically renewing subscription, you authorize recurring charges at the disclosed price and interval until you cancel. Renewal charges are processed according to the timing disclosed at purchase and the applicable payment platform rules. A trial or introductory offer converts to the disclosed paid price only as stated in the offer and with any consent required by applicable law.

You may cancel automatic renewal through the subscription settings of the platform or account used to purchase it, following the cancellation instructions disclosed with the offer. Contact support@nexoragame.org if you need help locating those controls. Deleting a game, deleting a game account, or simply stopping play does not itself cancel a subscription managed by a third-party platform.

Unless the offer, applicable law, or platform policy provides otherwise, cancellation stops future renewals and your benefits continue until the end of the paid period. Refunds, including refunds for unused time, are governed by applicable law and platform policy; cancellation does not waive any mandatory refund right. Trial benefits may end upon cancellation if that condition was disclosed in the offer.

We will give advance notice of material subscription price or benefit changes and obtain any consent required by law or platform policy before applying them. You may cancel renewal before a change takes effect. If a payment fails, benefits may be suspended or end after any applicable grace period; any payment retry will follow the purchase authorization and applicable platform rules.

We may adjust virtual items where reasonably necessary for security, legal compliance, or fair gameplay. If a change materially affects paid content, we will provide reasonable notice where practicable and any remedy required by applicable law or platform policy.

6. Advertising and Rewards

The Services contain advertising, including rewarded advertisements where offered. Advertisements may be provided by the distribution platform or other authorized providers, depending on the game and platform. Where a rewarded advertisement is offered, the game will describe the reward and the conditions for receiving it before you choose to view the advertisement. We will not describe a reward in a misleading way.

A paid purchase or subscription removes advertising only to the extent expressly stated in the offer. Any ad-free or reduced-ad offer will identify material exclusions, including whether optional rewarded advertisements remain available. The availability of advertisements and rewards may vary by region, device, and provider availability.

Rewards are granted when the disclosed conditions are met and completion is confirmed through the applicable system. If a technical issue prevents delivery, contact support@nexoragame.org so we can investigate and correct any verified delivery failure. Advertising does not guarantee the quality or availability of a third party's product. Advertising-related data practices are explained in the Privacy Policy.

7. Player Conduct

You must not use the Services to:

• Use cheats, bots, hacks, exploits, or unauthorized software to obtain an unfair advantage or bypass security measures.
• Disrupt the Services or attempt unauthorized access to accounts, servers, networks, or data.
• Harass, threaten, abuse, impersonate, defraud, or otherwise harm other users or our staff.
• Buy, sell, share, or transfer game accounts or virtual items outside expressly permitted features.
• Submit unlawful, infringing, hateful, sexually exploitative, or otherwise harmful content, or promote illegal gambling or other unlawful activities.
• Use the Services for unauthorized commercial activities or violate applicable law or platform rules.

You may report suspected violations through available reporting features or by contacting support@nexoragame.org.

8. User Content

This section applies only where the Services allow you to submit names, messages, images, feedback, or other content. You retain any ownership rights you hold in that content. You must have the rights necessary to submit it and must not include another person's personal information without a lawful basis.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and moderate your content only as reasonably necessary to provide, maintain, and protect the Services. We may allow service providers to perform those activities on our behalf for the same purposes. We will obtain separate permission where needed to use your content in external promotional materials.

The license ends when the content is deleted from our active Services, except to the limited extent needed for lawful retention, dispute resolution, or backups pending routine deletion. Personal data remains subject to the Privacy Policy and applicable law. We may remove or restrict content that violates these Terms, law, or applicable platform rules.

9. Updates and Service Changes

We may update, patch, rebalance, or change the Services for operational, security, legal, or gameplay reasons. Some updates may be necessary to continue using the Services. We do not promise that any particular feature or compatibility will remain available indefinitely.

For a material reduction in functionality or a planned permanent closure, we will provide reasonable advance notice where practicable. Urgent security issues, legal requirements, or circumstances outside our reasonable control may require action without advance notice. We will address affected paid content and outstanding purchases as required by applicable law and platform policy.

10. Suspension and Termination

We may restrict or suspend game access, remove content, or terminate access where we reasonably believe there has been a material violation of these Terms, fraud, unlawful conduct, infringement, or a threat to users or the Services. Our action will take account of the nature and seriousness of the issue.

Where practicable and lawful, we will explain the action and provide an opportunity to correct a remediable violation. You may request review by contacting support@nexoragame.org with your game identifier and relevant details. We may withhold information where disclosure would undermine security, an investigation, or legal obligations.

You may stop using the Services at any time. For game account deletion or personal data requests, use any available in-game controls or contact us as described in the Privacy Policy. Stopping use does not itself cancel a separately authorized subscription; use its disclosed cancellation process.

Termination does not remove accrued statutory rights or refund entitlements. Any handling of outstanding purchases, paid content, and retained data remains subject to applicable law, platform policy, and our Privacy Policy.

11. Third-Party Services

The Services may interact with the distribution platform, app stores, advertising providers, or other third-party services. Their services are governed by their own terms and privacy policies. We do not control their independent operations, but remain responsible for our own obligations and conduct. Nothing in this section excludes responsibility that applicable law does not permit us to exclude.

12. Disclaimers and Liability

To the extent permitted by applicable law, the Services are provided "as is" and "as available." We do not guarantee uninterrupted operation, compatibility with every device, or the absence of all errors. We will exercise any standard of care required by applicable law.

To the extent permitted by applicable law, NEXORA INTERACTIVE LLC and its officers, employees, and service providers are not liable for indirect or consequential losses, or loss of business profits, arising from use of the Services.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate misconduct, or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer rights, including remedies for defective or undelivered digital content, remain unaffected.

13. Responsibility for Claims

To the extent permitted by applicable law, you are responsible for third-party claims and reasonable, documented losses directly caused by your unlawful conduct, deliberate misuse of the Services, or knowing infringement of another person's rights. This does not apply to losses caused by our own breach, negligence, or misconduct, and does not impose an obligation on a minor where it would not be legally enforceable.

We will notify you of any claim for which we seek reimbursement and give you a reasonable opportunity to respond. We will not agree to a settlement imposing an obligation on you without your consent.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Kentucky, United States, excluding its conflict of law rules, except to the extent mandatory laws of your place of residence apply. Nothing in these Terms deprives you of protections or remedies under mandatory consumer laws.

Please contact support@nexoragame.org to raise a concern so we can try to resolve it. This does not require you to delay or waive a legal remedy. Disputes may be brought before a court with jurisdiction under applicable law. Nothing in these Terms requires you to bring a claim exclusively in the State of Kentucky, United States where you have a mandatory right to bring it elsewhere.

15. Changes to These Terms

We may revise these Terms to reflect changes to the Services, law, or our operations. We will update the date above. For material changes, we will provide reasonable advance notice through the Services, our website, or another appropriate method, and state when the changes take effect, unless immediate changes are necessary for legal or security reasons.

Where permitted by applicable law, continued use after the effective date constitutes acceptance. Where affirmative consent is required, we will request it. If you do not agree, you may stop using the Services; any accrued statutory rights and applicable refund entitlements remain unaffected.
